1. Agreement to these Terms
These Terms govern the use of Kaiwai Kaiwai (the “Service”), provided by RITO OKAMOTO (the “Operator”). By using the Service, you agree to these Terms and the Privacy Policy.
2. Eligibility and accounts
- You must be at least 13 years old to use the Service.
- Use only one authentic account per person.
- Keep your device and Apple account secure to prevent unauthorized use.
- Do not use false, impersonating, or rights-infringing profile information.
3. Joining a Kaiwai
Start a Kaiwai by choosing at least one friend. A user may participate in more than one active Kaiwai at the same time. Others can join an active Kaiwai using an invitation or its QR code shown by a participant, and the invited person confirms whether to join.
4. Content you post
You may post only videos, audio, images, and text that you have the right to record and share. You retain ownership of your content.
You grant the Operator permission to process your content only as needed to provide the Service, including storing it, showing it to participants in the same Kaiwai, and exporting it to devices. This permission is not used for advertising or selling content to third parties.
5. Prohibited conduct
You must not:
- Violate laws, public order, these Terms, or the Community Guidelines
- Harass, threaten, discriminate against, bully, or sexually exploit others
- Record or post private life or personal information without consent
- Infringe copyright, publicity, trademark, or other rights
- Promote dangerous conduct, crime, self-harm, or illegal goods or services
- Access, disrupt, analyze, or place excessive load on the Service without authorization
- Send spam, commit fraud, or buy, sell, or lend accounts
6. Safety enforcement
The Operator may review reported content for safety and, depending on the findings, hide or remove posts, restrict features, or suspend or delete accounts. Advance notice may not be given when a matter is urgent or a violation is serious.
7. Changes or suspension
All or part of the Service may be changed or suspended for maintenance, outages, safety, or legal compliance. Material changes will be announced where reasonably possible.
8. Disclaimer and liability
The Operator works to provide a safe and reliable Service but cannot guarantee that interruptions or data loss caused by networks, devices, or third-party services will never occur. Except where prohibited by law, the Operator is liable only for ordinary, direct damages caused by the Operator’s willful misconduct or gross negligence.
9. Account deletion
You may delete your account from the app at any time. Deleted accounts cannot be restored. If other participants remain in an active Kaiwai, the creator role and recording turn may be passed to a remaining participant. See the account deletion guide for details.
10. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Unless otherwise required by law, disputes relating to the Service are subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the Operator’s location as the court of first instance.
